ADCTA takes Stringent Action against High-Handedness of Delhi VAT Department

ADCTA has brought to the notice that they have received a number of complaints from traders against Delhi Trade Tax Department as they issued order for demand of VAT Under section 86, subsection 10 of DVAT Act 2004 on account of mismatch of annexure 2A and 2B submitted by respective dealers. It is observed that the said order was issued without giving any opportunity of personal hearing to the dealers, which is arbitrary and violation of fundamental rights of person as per Indian Constitution and also against the principal of Natural Justice.

In this regards the ADCTA members approached to appropriate officers in Delhi Trade Tax Department and expressed their resentments to them. It is analyzed that the said demands were issued due to fault of Department and dealers were innocent. Therefore it is highly objectionable. Consequently, they have taken serious view on this issue and forcibly pressuring to higher authorities to take legal action against concerned officers.

Therefore accordingly all Dealers of Nehru Place were informed that in case of any such notice/order or any communication by Delhi VAT department, may immediately contact to ADCTA.
